Except as specifically stated on this website, to the fullest extent permitted at law, neither Viva Trading (UK) Co Ltd nor any of its affiliates, directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this website or the information, content, materials or products included on this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties

We reserve the right to make changes to our website, policies, and these Conditions at any time.

Refunds or Replacement on Faulty delivery or Faulty Goods.

In the event we have sent an order in error, or the goods were in some way faulty, we will replace the goods and return them to you free of charge. We will also refund you, via your card, the value of the original P&P charge.  We cannot refund you more than original cost.

Alternatively, we will Refund the total value, including the P&P charge and no transaction charge will be made.  Due to the way the payment system / security works we are unable to refund a greater amount than was originally paid.

We rarely dispute a claim for faulty goods but we do reserve the right to dispute a claim.  

Faulty goods or an incorrect delivery must be returned to us within 14 days of receipt of goods.  If goods are received outside this time we reserve the right to decline the claim.

All goods sold by Minnetonka.co.uk are guaranteed against normal wear and tear for a period of not more than three months.  If, for any reason you believe the goods you have bought have developed a fault in this time, then you must return the goods to us with reference to the original Order number. We cannot deal with claims without proof of purchase.

We are unable to handle claims for faulty goods for Minnetonka products bought from anyone else and other than from Minnetonka.co.uk.

Product Information

We have made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

All sizes and measurements are approximate, however we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK an EU sizes. Please refer to the size guide for clarification.

We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Prices are subject to change without notice. Prices are inclusive of VAT (where applicable).

Goods are subject to availability. As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

We frequently update our web site. Some website promotions may not be available to customers in particular jurisdictions.

Force Majeure

Viva Trading (UK) Co Ltd shall not be liable for any delays in delivery or failure to deliver the product in the event this is caused by labour troubles, strikes, lock-outs, war, riots, fire, flood, terrorist action, storm, accidents, shortage of materials, breakdowns in factory or acts, rules, regulations, orders or directives by any government body or any acts of God beyond Viva Trading (UK) Co Ltd’s control.

Governing Law and Venue

All orders and disputes shall be subject to UK Law. Unless the Parties agree otherwise, no litigation in respect of any dispute between them shall proceed unless and until the Parties have used their best endeavours amicably to settle the dispute through non-binding confidential mediation. Mediation shall take place in England with a Mediator appointed by the Centre for Dispute Resolution and the costs of any such mediation process shall be shared equally between the Parties.
